
"Justice BV Nagarathna: Children with Disabilities Deserve the Right to be Constructive, Accountable Citizens"
Justice B.V. Nagarathna, a Judge of the Supreme Court, emphasized the importance of streamlining data collection on children involved in the Juvenile Justice System, focusing on key indicators set by the Supreme Court. She called for consistent data updates, monitoring, and necessary corrective measures. Speaking as the Chairperson of the Juvenile Justice Committee at the 9th National Annual Stakeholders Consultation on ‘Protecting the Rights of Children with Disabilities (with focus on CiCL and CNCP) and Intersectionality of Disabilities,’ Justice Nagarathna reinforced the importance of accurate data to ensure these children’s rights are upheld. In the event's opening remarks, Chief Justice of India Dr. D.Y. Chandrachud highlighted the significant challenge posed by the lack of reliable, real-time data on children with disabilities, especially those who are survivors of sexual offenses or in conflict with the law. He pointed out that the absence of detailed, disaggregated data hinders effective planning and policy-making. Justice Nagarathna echoed his sentiments, noting that the process of collecting disaggregated data began last year. She urged stakeholders to stay focused on meaningful outcomes, emphasizing the need for "supported decision-making" rather than "substituted decision-making." She also critiqued the tendency to treat people with disabilities paternalistically, advocating for an inclusive environment where children with disabilities are empowered to live as fully integrated members of society. "These children, like any others, deserve the right to make mistakes, learn, and grow in a supportive family environment," she said. Justice Nagarathna stressed the responsibility of society to support children with disabilities in achieving their goals and not to allow their disabilities to become an excuse for settling for less.
